Professionals around the world (even those already working in the United States) often face the same question:
how can they secure the permanent right to move to (or stay in) the U.S.?
For many high-achieving founders, researchers, executives, and creatives, obtaining the right immigration status is a key strategic move toward reaching their full professional potential.
Our underlying mission is simple: to help talented individuals create more value in the world. For many professionals, moving to the United States through the right immigration pathway — whether a U.S. business visa, an America business visa, the EB1A visa, EB2 visa, or NIW visa — provides the stability, market access, and opportunity needed to maximize their impact.
This article features a structured visa type self-assessment quiz designed to help you evaluate which pathway may best align with your background, ambitions, and timeline.

U.S. Visa Types Selection
Professionals often default to familiar visa options like the H-1B or O-1. While each has its own benefits, the EB-1A visa offers several key advantages:

Wait Times for Each U.S. Visa
Aside from eligibility, another major factor for professionals planning to move to the U.S. is how long it takes to actually receive the visa or green card. Below is a simplified overview of typical wait times for each visa type mentioned:
EB-1A Visa (Extraordinary Ability – Green Card)
Estimated Time: 6 to 12 months
Details:
If the visa category is “current” in the Visa Bulletin, processing can be very fast, especially with premium processing for Form I-140 (15 calendar days).
Adjustment of status or consular processing adds about 16–18 months depending on the case.
Foreign nationals in the EB-1 category currently have shorter waits compared to EB-2 and EB-3.
O-1 Visa (Extraordinary Ability – Temporary)
Estimated Time: 5 to 9 months
Details:
Faster with premium processing.
As a non-immigrant visa, O-1 approval is relatively quick once a U.S. sponsor submits the petition.
This is a temporary visa and must be renewed if the work continues.
H-1B Visa (Specialty Occupation – Temporary)
Estimated Time: 6 to 12 months (if selected in lottery)
Details:
Lottery held in March each year, with a 1 in 3 (approx.) chance of selection.
If selected, approval and start dates usually occur in October of the same year.
Significant delays occur due to the annual cap and high demand.
Green card processing through H-1B can take 10+ years for Foreign nationals due to backlog in EB-2 and EB-3 categories.
EB-2 / EB-3 (Employer-Sponsored Green Cards)
Estimated Time for Foreign Applicants: 10–15+ years
Details:
These categories have some of the longest wait times for foreign nationals.
Requires employer sponsorship and PERM labor certification (except National Interest Waiver).
Delays are primarily due to visa number backlogs and country-based quotas.

Eb-1A Requirements
Who Qualifies for “Extraordinary Ability”?
The EB-1A visa is designed for individuals who have demonstrated extraordinary ability in their field. But what does that actually mean in practice?
In simple terms, “extraordinary ability” refers to being among the top of your profession, meaning you can demonstrate a consistent record of excellence and national or international recognition in your field. This applies to a wide range of industries including science, technology, business, education, arts, and athletics.
Do You Qualify for Extraordinary Ability?
Many professionals mistakenly assume that EB-1A is out of reach. In reality, with a strategic presentation of your accomplishments—especially if you’ve published, led teams, judged work, or made significant contributions—you may already meet the threshold.
An analysis of your career profile can determine strategic opportunities for you to become qualified. These can include specific actions you should take, organizations you should join, and opportunities you should be connected with. The key is framing your achievements with the right legal and evidentiary support.
How USCIS Defines Extraordinary Ability
To qualify for the EB-1A visa, you must meet at least 3 out of 10 criteria set by U.S. Citizenship and Immigration Services (USCIS) or provide proof of a major one-time achievement like a Pulitzer, Oscar, or internationally recognized award. Here are the 10 possible criteria:
Receipt of lesser nationally or internationally recognized prizes or awards for excellence.
Membership in associations that require outstanding achievements.
Published material about you in professional or major trade publications.
Judging the work of others, either individually or on a panel.
Original contributions of major significance to your field.
Authorship of scholarly articles in professional journals or other major media.
Exhibited work in artistic exhibitions or showcases (for artists, designers, etc.).
Leading or critical role in distinguished organizations.
High salary or other significantly high remuneration compared to others in your field.
Commercial successes in the performing arts.
You’ll need to provide strong documentation for each criterion you claim—this could include award certificates, media coverage, recommendation letters, proof of salary, publication records, or examples of your work impacting your field.
Common Fields for EB-1A Applicants
Technology & Engineering: Founders, lead developers, patent holders, conference speakers.
Science & Research: PhDs, published researchers, peer reviewers, grant recipients.
Business: Startup founders, executives, investors, innovators with industry influence.
Arts & Design: Filmmakers, musicians, designers, and others with commercial or critical success.
Education: Professors, thought leaders, published academic contributors.
Extraordinary Ability Summary
Extraordinary ability doesn’t mean perfection—it means proven excellence and recognition above the norm. With a strong record and a focused application, the EB-1A is within reach for many high-achieving professionals.
